피고인은 중국인 불법체류자이고, 2014. 초부터 중국 전화금융사기 조직의 인출총책인 일명 ‘C’의 지시를 받고 국내에서 활동하는 편취금액 인출책으로서, 성명불상의 유인책이 대한민국에 있는 피해자들에게 무작위로 전화를 걸어 대출을 해 준다고 속이고 대출에 필요한 비용 등을 송금하게 하거나, 피해자들이 인터넷 사이트 등에서 결재를 하기 위해 접속하는 경우, 보안카드 일련번호, 인적사항, 계좌번호 등을 입력하도록 유인하는 팝업창을 띄우는 방법으로 계좌이체에 필요한 정보를 알아내어 직접 예금을 이체하면 즉시 인출총책인 ‘C’ 등은 피고인들을 비롯한 성명불상의 인출책에게 위챗(wechat)이나 큐큐(QQ)메신저 등의 SNS를 통하여 미리 수집한 계좌와 연결된 통장 또는 카드를 수령할 장소와 방법을 알려주고, 이후 이를 가지고 현금 인출기에서 돈을 인출하도록 지시하고, 피고인들은 위 지시에 따라 통장 및 현금 카드를 전달받아 직접 피해금을 인출하여 위 ‘C’이나 그가 지정하는 전달책에게 전달하거나 지정하는 계좌로 송금하는 방법으로 금원을 편취하기로 순차적으로 공모하였다.
