A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Although petroleum retailers, etc. violating the Petroleum and Petroleum Substitute Fuel Business Act are prohibited from selling petroleum, light oil, light oil for ships, etc. as fuel for automobiles, etc., the Defendant, on June 2016, intended to sell petroleum oil, etc., the value of which is lower than that of the original fuel of the freight vehicle, to freight truck articles, such as D, E, etc., due to economic difficulties that may make it difficult for the Defendant to sell it as fuel for automobiles.

Accordingly, the defendant sold a light oil as fuel for the automobile.
2. The fraud oil subsidy scheme provides subsidies (345.54 won per square meter per square meter) to the local government of the following month in relation to the quantity of the oil used for the actual operation of a commercial motor vehicle. The Defendant received the fuel subsidy card in advance from the driver of the trucking vehicle, such as D and E, and in fact, conspired with the aforementioned D, E, etc. by paying the card as if the same amount of the oil was limited, even though it was actually harmful to the driver.
Accordingly, the Defendant, as described in the preceding paragraph from June 14, 2016 to February 1, 2017, sold glass to the said D, E, etc. and sold via the same amount of transit, and then settled with a cargo welfare card and its affiliated local government.
