A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who resides in the city of tardo and operates an online shopping mall for purchase agency online (B).

외국물품을 수입할 때에는 당해물품의 품명, 규격, 수량, 가격 등 대통령령이 정하는 사항을 정확하게 세관에 신고하여야 하는데도, 피고인은 2016. 9. 4.경 국내로 입국하면서 위 인터넷 블로그를 통해 판매하고자 물품원가 9,600,000원(범칙시가 11,300,000원) 상당 롤렉스(ROLEX) 1개를 세관에 수입신고 없이 일명 ‘핸드캐리’하는 방법으로 수입한 것을 비롯하여 그때부터 2018. 3. 18.경까지 별지 범죄일람표 기재와 같이 총 32회에 걸쳐 롤렉스시계 등 32개 물품원가 282,565,850원(범칙시가 298,819,430원) 상당을 세관에 신고를 하지 아니하고 ‘핸드캐리’하는 방법 등으로 수입하였다.

The sum of the cost of goods imported by the Defendant for the reason of sentencing under Article 282(3) and (2) of the Customs Act is as close as KRW 300 million, the period of the crime is 18 months, and the crime is committed to sell overseas printed goods by evading customs duties. It is not good that the crime is committed.

The crime of smuggling is the development of the national economy by properly imposing and collecting customs duties and customs clearance for imported goods and securing the import of customs duties.
