A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

On September 27, 2013, the Defendant was sentenced to a suspended sentence of four months of imprisonment for fraud at the Ulsan District Court on September 27, 2013, and the said judgment became final and conclusive on October 5, 2013, and is still in the grace period.

1. The Defendant: (a) around 10:00 on January 31, 2015, on the victim E-owned FF MM (SM3) car parked on the front of the Dphilosophical hall located in Sin-si, Sin-si, and entered into a top door door door door door door door door door door door door door door door door door door door door door door door door door door door door door door to which no correction of any gaps of surrounding surveillance was made; and (b) was stolen with KRW 130,00,000 at the market price owned by the victim within the back door door door door door door of the victim, which was located on the back door of the vehicle.

2. The Defendant violated the Fraud and the Specialized Credit Financial Business Act by taking advantage of the victim’s Samsung Credit Card, which was stolen and possessed as seen above, intended to settle bus passes, meal and lodging expenses, etc. Accordingly, the Defendant used the stolen Samsung Credit Card under five times as if the Defendant was a legitimate credit card user, and acquired property equivalent to 101,900 won in total at market price by deceiving another person.

On January 31, 2015, the Defendant, at around 11:40 on January 31, 2015, issued tickets at the right time of the unmanned bus riding tickets located in a bus bus terminal in the Nowon-gu, Nowon-gu, 160-2 racing, and as above, used the stolen Samsung Credit Card under the name of the Defendant as if the Defendant was a legitimate credit card user. In such a way, the Defendant was issued bus passes from the Federation of Korea Bus Transport Business Associations of Victims by deceiving the Federation of Korea Bus Transport Business Associations of Victims.

B. On January 31, 2015, the Defendant, at around 14:22, issued tickets at the time of the issuance of the above unmanned bus tickets, used Samsung Credit Card under the name of Samsung, which was stolen as if the Defendant was a legitimate credit card user, as if the Defendant were a legitimate credit card user.
