A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On July 10, 2015, around 05:32, the Defendant: (a) discovered the victim C, who was engaged in being employed by the passengers in the second floor of the waiting room in the Seoul Central District, the second floor of the waiting room in Yongsan-gu Seoul, Yongsan-gu, Seoul, and then stolen the victim’s cash 90,000 won, SK gift certificates 50,000 won, identification card 1 copy, credit card 1, credit card 1, 1, 1, 1, 1, 1, and 1 bank physical card knives that contain the victim’s cash 90,000 won, 500 won, 50,000 won, and 1,000 won.
2. Fraud or violation of the Specialized Credit Finance Business Act;
A. At around 07:10 on the same day, the Defendant purchased bus passes through the bus passes automatic ticket sales machines administered by the victim F at Asan City, at around 07:10 on the same day, and settled it by means of inserting the above e-mail card at the above e-mail and signing it on the e-mail, and then received boarding passes equivalent to the sum of 15,900 won at the victim’s market price at the e-mail. At around 07:11 on the same day, the Defendant was issued with boarding passes equivalent to the sum of 24,000 won at the market price at around 07:13 on the same day. On the same day, the Defendant was issued with boarding passes equivalent to the sum of 85,500 won at the market price around the same day.
Accordingly, the defendant, by deceiving the victim, received the property and used the stolen debit card.
B. At around 07:18 on the same day, the Defendant purchased two cigarette from the G convenience store operated by the victim under the name in the above E, presented as if the victim had legitimate authority to use the stolen e-mail card, and settled it by signing on the electronic e-mail, and received two cigarettes from the victim, namely, by a horse at a total amount of KRW 90,000 in the market price owned by the victim.
Accordingly, the defendant deceivings the victim to receive property, and uses stolen debit cards.
