A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

1. From March 2014, around March 2014, around the end of 2014, the defrauded made a false statement to the effect that “If he/she lends money to the victim D, he/she may purchase the money at the low price, he/she shall make a full payment of profits if he/she lends money to the victim D in the residence of the victim D, who is located under the Busan Southern-gu building B building C.

However, the defendant, as a family owner, did not have any other income than the monthly income of her husband, did not have personal property as well as approximately KRW 100 million, and was willing to use the above loan as the defendant's debt repayment and living expenses without investing it in the auction business conducted by the defendant, so even if he borrowed money from the victim for the purpose of investment in auction business, he did not have any intention or ability to repay it.

As above, the Defendant, by deceiving the victim as above, received a total of KRW 100 million from March 2014 to the end of March 2014 from the victim.

2. From August 17, 2015 to May 23, 2017, the defrauded Defendant made a false statement to the effect that “Around July 2015, the Defendant would dispose of real estate owned by the former KRW 100 million and would be repaid to the bank in order to obtain a real estate loan.”

However, in fact, the Defendant did not have real estate owned by the Defendant, and there was no personal debt equivalent to KRW 100,000,000 as stated in paragraph (1). Since the Defendant did not use the borrowed money as bank expense and intended to use it as the Defendant’s debt repayment and living expense, the Defendant did not have any intent or ability to pay the borrowed money even if he borrowed money from the victim under the pretext of street.

As above, the Defendant, by deceiving the victim and deceiving the victim, is the post office of F around 14:51 on August 17, 2015.
