Criminal facts

1. Fraud;

A. At around 18:00 on May 1, 2019, the Defendant related to Aphone XS MAS cell phone accessed to “D” the Internet used a mobile phone from the fourth living unit in Seo-gu Incheon, Seo-gu, Incheon, to sell the said device despite the absence of intent or ability to sell the devices, and then posted a notice to sell the said device on or around the second day of the same month, the Defendant transferred KRW 800,000 from the victim E and the victim F to H(I) account in the name of the Defendant on or around the third day of the same month, and acquired KRW 750,000 from the victim J on or around the 6th day of the same month, and KRW 750,000 from the victim K to the Defendant’s account in the name of the Defendant.

나. 에어팟 관련 피고인은 2019. 5. 6. 19:06경 위와 같은 장소에서 위 피해자 E과 위 아이폰에 관한 전화통화를 하던 중 피해자가 무선이어폰 에어팟 구매를 고민한다고 하자 에어팟을 판매할 의사나 능력이 없음에도 불구하고 피해자에게 에어팟을 판매하겠다고 하여 이에 속은 피해자로부터 같은 날 위 H 계좌로 18만 원을 이체받아 편취하였다.

2.
