A and B Co., Ltd. shall be punished by each fine of KRW 5,00,000, and Defendant C and D shall be punished by each fine of KRW 3,00,000.

Defendant

B A Co., Ltd. (hereinafter referred to as “B”) has its head office in Gangseo-gu Busan Metropolitan City and has been engaged in port service business with 205 workers, and entered into an “G management and operation contract” with F Co., Ltd. around December 201, and actually operates and manages the above container terminal.

Defendant

A is a person in general charge of safety and health who is responsible for matters concerning the safety and health of workers under the above B and workers employed by the contractor. Defendant C is a person who performs overall control over the operation of the above container terminal, the maintenance and repair of facilities and equipment, safety management, etc. as the chief of the operation headquarters of the above B. Defendant D is an employee of H who has received facility management, etc. in the above terminal from November 17, 2017 to the employees of the corporation H who are contracted with the above terminal facilities management, etc. in the above terminal from November 17, 2017, and performs duties for the management and supervision, such as access control, etc. of workers

The victim I (the 44 years of age) is an employee of JJ, who was awarded a contract for L Repair Work in the above container terminal located in Gangseo-gu Busan on November 17, 2017 by the above B and performed the said repair work at the container terminal.

1. Defendant A (related to violations of the Occupational Safety and Health Act);

(a) The business owner shall prohibit persons, other than his/her workers, from entering a place where it is dangerous to decrease spawn cargo, by installing a fence, etc.;

Nevertheless, at around 12:10 on June 1, 2018, the Defendant did not take measures to prohibit entry, such as installing fences between the air storage facility of the freezing container in Gangseo-gu Busan, which is a place at which the freezing container (4.6 tons), which is a place at which the cresh container (4.6 tons) in the cresh (name of equipment, ARG, human height 18m) will fall.

(b) Business owners shall handle work and heavy objects using loading and unloading transportation machinery of vehicles;
