Reasons
Punishment of the crime
1. Defendant B is the regular director of the Company A, and is the manager in charge of the safety and health management of the counter-month factory A in Ansan-si.
(a) Engines. The business owner who violates the prevention of danger, such as power failure, etc. shall install a motor, electric percussion system, swimming, swimming, fluor, flass chairs, bell, slick, slick, etc. on the part of a machine which is likely to face danger to workers, such as a chain;

Nevertheless, on June 3, 2015, the Defendant did not take measures such as installing fences on a bridge with a height of about 2 meters at the above half-month factory on the fourth floor of a height of about 2 meters.
As a result, the Defendant did not take necessary measures to prevent the risk at a place where a worker might fall during work.

A business owner who violates the prohibition of entry and exit shall prohibit persons other than the workers concerned from entering the sealed space and post the details thereof at a place easily visible.
Nevertheless, on June 3, 2015, the Defendant did not affix a warning sign to the closed space that prohibits a person, other than the relevant employee, from having access to the wastewater treatment site of the above half-month factory around June 3, 2015.
Accordingly, the Defendant did not take necessary measures to prevent health hazards caused by the smuggling work.
2. Defendant A Co., Ltd. is a corporation whose head office is located in Ssung City D, which employs 63 full-time workers.
