[Defendant A] The defendant A shall be punished by imprisonment for one year.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] On May 23, 2019, Defendant A was sentenced to a suspended sentence of one year of imprisonment for a crime of aiding and abetting fraud at the Gwangju District Court, and the judgment became final and conclusive on May 31, 2019.

1. Defendant A

A. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) Defendant A is engaged in driving a car with C AD.

Defendant

A, around 03:40 on December 15, 2018, while under the influence of alcohol, driving the said car with 0.125% of alcohol level 0.125%, and driving the first three-lane road in front of the shooting distance of veterans hospitals in Gwangju Mine-dong, Busan Metropolitan City from D Burial to Ehh.

In such cases, a person engaged in driving of a motor vehicle shall not drive a motor vehicle in a state where normal driving is difficult due to influence of drinking, and the driver has a duty of care to check whether there is a motor vehicle driving through the intersection by reducing speed and checking well the side, and to prevent accidents by driving the motor vehicle safely according to the traffic signal in advance.

Nevertheless, Defendant A was driven by the victim F(the age of 27) who is in the same direction as that of Defendant A due to the negligence of neglecting this, and driving in the same direction as that of Defendant A’s vehicle, and the part behind the G K5 car, which was driven by Defendant A, was in the front part of Defendant A’s vehicle.

As a result, Defendant A driven a motor vehicle in a state where normal driving is difficult due to influence of alcohol, and due to the above occupational negligence, Defendant A suffered the victim F by the following: (a) the base and tension of the trend, the base and tension of the chill; and (b) the base and tension of the chill that requires the victim H(30 years of age) treatment for about three weeks to the passengers of the damaged vehicle; and (c) the base and tension of the tension.

B. Defendant A is under the influence of alcohol level around 03:40 on December 15, 2018, Defendant A from the roads in front of the J Ifon House Parking Lot in Gwangju Mine-gu, while under the influence of alcohol level of 0.125% on blood alcohol level at around 03:40 on December 15, 2018.
