1. 총책 X 등과 관련된 피고인 A, 피고인 B, 피고인 C, 피고인 D, 피고인 E, 피고인 F, 피고인 G의 공동 범행 피고인들은 X, Y 등과 함께 대구 일대에서 수사기관의 단속을 피하여 야산 또는 주택가를 돌아다니면서 속칭 ‘ 도리 짓고땡’ 도박판을 개장하기로 하고, X는 도박판 전체를 기획 ㆍ 관리하고 도박판을 운영하는 책임자 역할( 속칭 ‘ 창고’) 을, 피고인 G과 Y은 도박 참가자들에게 도박자금을 빌려 주고 고율의 이자를 받는 전주 역할( 속칭 ‘ 꽁지’) 을, 피고인 A는 위 전주 역할과 함께 도박 참가자들에게 화투를 돌리는 역할( 속칭 ‘ 마 개사’) 을, 피고인 B과 피고인 C는 도박 현장에 있으면서 도박 참여자들에게 커피 등 심부름을 해 주는 역할( 속칭 ‘ 주방’) 을, 피고인 D은 도박 현장 및 부근에서 단속 등에 대비하여 망을 보는 역할( 속칭 ‘ 문방’) 을, 피고인 E은 도박 참가자들이 얼마를 승하고 얼마를 잃었는지를 장부에 기재하는 역할( 속칭 ‘ 장 부’) 을, 피고인 F은 도박판에서 승패가 결정되면 패자의 돈을 걷어서 승자에게 나눠 주고 경비를 떼어 주는 역할( 속칭 ‘ 상 치기’) 을 각각 담당하기로 상호 공모하였다.
