1. The defendant shall pay to the plaintiff KRW 40,700,000 and KRW 37,000 among them, 24% per annum from December 31, 2009 to the date of full payment.

The Plaintiff loaned KRW 37 million to the Defendant at an interest rate of 25% per month. The Defendant, on April 22, 2009, agreed to pay to the Plaintiff KRW 40,77 million including the above principal of the loan and interest accrued during the loan up to December 30, 2009, by December 30, 2009, either there is no dispute between the parties or by the statement of the evidence No. 1 (Evidence). Thus, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of KRW 24% per annum, which is the above agreed interest rate from December 31, 2009 to the day of full payment, from December 31, 2009 to the day of full payment.

Therefore, the plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
