Reasons
The defendant, citing the judgment of the court of first instance, submitted only a petition of appeal without stating the grounds for appeal, and did not submit a document stating the grounds for appeal, and did not appear at the date of pleading of this court.
Even if this Court re-examines the allegations and the evidence submitted by the plaintiff, it is justifiable to find facts at the first instance court and determine.
The reasons to be stated by this court are the same as that of the judgment of the court of first instance, and they are cited by the main sentence of Article 420 of the Civil Procedure Act.
Therefore, the plaintiff's claim in the principal lawsuit should be accepted within the scope of the above recognition, and the remainder of the principal lawsuit and the defendant's counterclaim should be dismissed for lack of reasonable grounds.
The judgment of the first instance is just in conclusion, and the defendant's appeal is dismissed as it is without merit. It is so decided as per Disposition by the assent of all participating Justices.
