1. Around 01:00 on May 23, 2019, the Defendant: (a) discovered the fact that possession was carried out with the victim B’s cell phone units, resident registration certificates, driver’s licenses, and corporate bank D credit cards in the name of the corporation C, and carried out necessary procedures, such as returning to the victim.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. On May 23, 2019, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) around 01:39, at the G convenience store operated by the Victim F in Nam-si, Namyang-si, as if the Defendant was the lawful holder of the company-bank D credit card acquired as referred to in the foregoing paragraph (1), and (b) as if the Plaintiff was the lawful holder of the above paragraph (1), the Defendant 2 A tobacco amounting to 8,000 won in total from the victim; and (c) from that time, the Defendant 2 A tobacco amounting to 8,000 won in total at the market price from the victim; and (d) from that time until May 23, 2019 to May 03:54, 2019, the Defendant collected tobacco amounting to 196,000 won in total at the market price from the victims and settled

Accordingly, the defendant deceiving the victims, received property, and used the lost credit card.

2. Fraud by using computers, etc.;

A. On May 23, 2019, around 03:26, the Defendant: (a) purchased gift certificates by paying in small amount using the mobile phone devices of H building No. 1; and (b) purchased and commercialized gift certificates using the mobile phone devices of B acquired as set forth in the foregoing paragraph (1); and (c) had access to the “J” website without B’s consent, and acquired KRW 10,000 by paying in small amount when the Defendant purchased gift certificates from the victim J corporation.

Accordingly, the defendant acquired property benefits by inputting information without authority into a computer or any other information processing device.

B. The Defendant: (a) around 04:35 on May 23, 2019; (b) around 04:35, on the ground that he fell under the H building I.
