Reasons
Punishment of the crime
[Criminal Power] On November 1, 2016, Defendant A sentenced two years and three months to imprisonment for a violation of the Act on the Control of Narcotics, Etc. at the Gwangju District Court, and completed the execution of the said sentence at the Gran Prison on May 3, 2018. Defendant B sentenced Defendant B to imprisonment for a violation of the Act on the Control of Narcotics, etc. at the Cheongju District Court on July 7, 2016 and completed the execution of the said sentence on December 12, 2017.
【Criminal Facts】
Defendants are not narcotics handlers.
1. Defendant A
A. On April 21, 2019, the Defendant: (a) sold Macampphones (hereinafter “Macamphones”); (b) on April 23:19, the Defendant deposited KRW 1.8 million in the Agricultural Cooperative account (Account Number D) in the name of the Defendant; and (c) on April 22, 2019, the Defendant purchased and sold Macamphones by means of cutting about 10 g of a vinyl, which is 10g of a philopon, from the Seoul Songpa-gu and the F gas charging station parking lots, to G that caused philopon in accordance with C and public offering.
B. (1) On April 2019, the Defendant received philophones in a way that 0.05g of philophones from Ha Government-si H building I to B free of charge, on the top of 16:00 on the scopphones from April 2019.
(2) On April 2019, the Defendant received approximately 0.05 g of philophones from H Building I to B at the time of the Government of Jon-si, Jin-si, Jin-si, in a way that philophones were dried free of charge.
(3) On May 2019, the Defendant received philophones in a way that 0.05g of philophones possessed in the H building I from the Government of the Republic of Korea, Sin-si, H building I free of charge, by giving and receiving philophones.
(4) At around 03:30 on May 16, 2019, the Defendant accepted philophones by means of giving approximately 2.25 g of philophones to B free of charge. (c) On May 16, 2019, the Defendant, from around 10:13 to 10:15 on May 16, 2019, by inserting approximately 0.1 g of philophones into the part of Jurher in a single-use tool and dilution them into the Defendant’s left part of blood cells.
