1. The Defendant shall pay to the Plaintiff KRW 127,440,00 and the interest rate of KRW 15% per annum from October 22, 2015 to the date of full payment.

The plaintiff asserts that the defendant lent the total amount of KRW 159,40,000 to the defendant on April 25, 2007, KRW 32,000,000 on April 30, 2007, KRW 50,000 on May 9, 2007, KRW 27,600,000 on July 12, 2007, and KRW 159,440,00 on August 20, 207 without fixing the due date for payment. The plaintiff shall be deemed to have been led to the confession of the defendant under Article 150 of the Civil Procedure Act. Meanwhile, the plaintiff received KRW 32,00,00 on April 30, 207, and it is evident that the copy of the complaint in this case was served on the defendant.

Therefore, the defendant is obligated to pay the plaintiff the amount of 127,440,000 won (=159,440,000 won-32,000,000 won) and damages for delay at the rate of 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from October 22, 2015 to the date of full payment, on the record that it is obvious that the delivery day of the copy of the complaint of this case is the day following the delivery day of the copy of the complaint of this case.
