A defendant shall be punished by imprisonment for one year.

Punishment of the crime

B. On January 7, 2016, the Defendant entered the 2nd female toilets of “F” located in the Donsan-si, Donsan-do, North Korea, in order to take photographs using the Defendant’s handphone camera functions.

Accordingly, the defendant invadedd his sexual desire at public places to satisfy his own sexual desire.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and other crimes);

가. 피고 인은 위 제 1의 가항 기재 일시, 장소에서 화장실 안에 있는 용변 칸에 들어가 칸막이 아래로 카메라 기능이 내장된 피고인의 핸드폰을 밀어넣은 다음, 옆 용변 칸에 앉아 용변을 보고 있던 피해자 G( 여, 39세) 의 신체를 촬영하려고 하였으나, 이를 눈치 챈 피해자가 용변 칸 칸막이를 두드리면서 항의하는 바람에 촬영을 끝마치지 못하고 달아났다.
