A defendant shall be punished by imprisonment for six months.

Punishment of the crime

When the Defendant embezzled the funds of limited partnership C (hereinafter “C”) and was urged to put up a guarantor for the embezzlement repayment obligation, the Defendant was willing to forge the letter of commitment and the power of attorney for the preparation of authentic deeds by pretending to be joint and several sureties, even though he did not have obtained the consent from the wife D (after the name of the wife) to guarantee the Defendant’s obligation.

1. Forgery of private documents and the display of private documents;

A. At around 08:00 on November 11, 2013, the Defendant: (a) stated that “A shall repay all of the amount of occupational embezzlement from C by November 20, 2013” in the white paper using an official approval color pen and, without obtaining the said D’s consent, he/she shall accept any measures taken by the Company; (b) forged one copy of the letter of repayment under the above D, a private document on rights and obligations; and (c) delivered it to H on November 13, 2013, the representative director of the C office located in the Busan Geum-gu Busan Metropolitan Government, with the aim of exercising the said D’s right and obligations.

B. At around 17:00 on November 12, 2013, the Defendant forged a letter of delegation for issuance of a certificate of seal imprint, which is a private document on the rights and obligations affixed with the seal imprint affixed to the name of the delegating, resident registration number I, address J of Busan City, etc., and submitted it to the public service center in the name omitted of the fact that he/she knew of the fact.

C. On November 27, 2013, the Defendant forged power of attorney for commission of preparation of authentic deeds and exercised such power of attorney at the Busan Dong-dong Office of Law Firm, Busan, 112 Doo-ro, Busan, Daegu, Busan, 100,00.
