The prosecutor's appeal is dismissed.
Reasons
The judgment of innocence by the court below on the summary of the grounds for appeal was appealed by the prosecutor that the mistake of facts and the violation of statutes affected the judgment.
The summary of the facts charged and the facts charged in the judgment of the court below is that the Defendant will lend a loan to the Defendant if he/she sends a physical check for automatic transfer registration from his/her nameless person on May 30, 2019.

As a result, the Defendant promised to return the intangible expected interest to receive future loans in return for the future and lent the access media to the name influence.
The judgment of the court of the court below seems to have done the above act as a means to obtain a loan after hearing the words of the lending officer that the defendant sent a physical card to the lending company for the repayment of principal and interest, and allowed another person to conduct an electronic financial transaction at his/her discretion using an access medium in return for the loan.
For the reasons that it is difficult to see that the defendant was acquitted.
According to Article 6(3)2 of the Electronic Financial Transactions Act, which is a legal provision that applies to the indictment of this Court, no one may borrow or lend an access medium, or store, deliver, or distribute the access medium with the receipt, demand, or promise of the consideration in using or managing the access medium.
“Lending access media” refers to lending access media to another person to conduct electronic financial transactions by using access media without managing or supervising the user of the access media while receiving, demanding, or promising to receive, demand, or promise a consideration.
In order to punish a person who lends an access medium in violation of the above provision pursuant to Article 49(4)(2) of the Act, "other person."
