All prosecutions against the Defendants are dismissed.

1. Defendant A was serving as a contracting officer belonging to the Ministry of Environment H Team, and Defendant B served as a secretary of the I candidate who was going to a considerable area of the election of the National Assembly member held on April 11, 2012. Defendant C is a member of the Internet homepage-making company of J, a corporation, who worked at the I candidate election campaign office to manage the I candidate website at the time of the election of the National Assembly member. Defendant D was a volunteer of the I candidate election campaign office. Defendant E is a volunteer of the I candidate election campaign office. Defendant E is a person in charge of cyber-related duties as a volunteer of the I candidate election campaign office.

Defendant

On April 8, 2012, the Defendant sent a text message to B using the Defendant’s smartphone (K) to the effect that “L was suffering from the pain of a pregnant son who was imprisoned to the recent workplace where the Defendant works.”

Accordingly, the defendant injured the victim's reputation by openly pointing out facts and insultd the victim's L.

B. On April 8, 2012, Defendant B told Defendant B’s defamation and insult to the following purport: (a) around April 15:00, 2012, Defendant displayed the text message sent by Defendant A to several reporters, such as East Asia, M, etc., in the first floor of the Cheongbuk-do Office, which is located in the cultural dong-gu, Cheongju-si; and (b) read Defendant B to the effect that “L made a declaration of conscience related to the purchase of a candidate’s sexual intercourse, and such remarks are without value to believe.”

As a result, the Defendant damaged the reputation of the victim by openly pointing out facts, and insultd the victim L.

C. Defendant B, Defendant C, Defendant D, and Defendant E, in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (Defamation) on April 10, 2012, Defendant B sent them to Defendant C, Defendant D, and Defendant E at the I candidate election campaign office located in the area corresponding to Cheongju-si around April 10, 2012.
