A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On May 26, 2014, at around 22:35, the Defendant driven a BL car with a blood alcohol content of at least 0.120% while under the influence of alcohol at a section of approximately four meters of the 178-lane in front of the office of Paridiflas, Co., Ltd., Ltd., located in Bupyeong-gu Incheon, Bupyeong-gu, Bupyeong-gu, Incheon.
2. A violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicles) is a person engaging in driving a BRati car.
The defendant operated the car at the same date, time, place as described in paragraph (1) and proceeded with the two-lane road at an indefinite speed.
At the time, there were nights, the width of the road is narrow, and vehicles are parked at the edge of the road, so in such a case, there was a duty of care to safely drive the vehicle with the front and rear left and prevent the traffic accident by safely driving it.
Nevertheless, under the influence of alcohol, the Defendant parked the vehicle in the right edge of the progress direction by neglecting the vehicle hand over to the right edge, and parked the part of the driver's seat of the marina vehicle on which the victim C (the age of 24) was on board. The above victim continued to drive the vehicle out of the vehicle and the accident as it is, and received the part of the victim's left side buckbucks.
Ultimately, the Defendant, by occupational negligence, sustained bodily injury to the victim, such as a broad bridge, which requires treatment for about two weeks, but failed to immediately stop and take necessary measures, such as aiding the victim.
