A defendant shall be punished by imprisonment for one year.

703,000 won shall be additionally collected from the defendant.

The additional collection charge shall be equivalent to the above additional collection charge.

Punishment of the crime

【Criminal Records of Crimes】 On November 10, 2017, the Defendant was sentenced to a three-year suspended sentence of imprisonment with labor for a violation of the Narcotics Control Act at the Incheon District Court on the grounds of a violation of the Act on the Control of Narcotics, etc., and the judgment became final and conclusive on November 18, 2017 and is currently under suspended sentence.

[Criminal Facts]

1. On January 28, 2018, the Defendant: (a) issued a written order to a person under whose name it is a book (i.e., a one-time, a penphone; hereinafter “philopon”); (b) issued a written order to a person under whose name it is a book (i.e., a one-time, a penphone; hereinafter “philopon”); and (c) transferred KRW 700,000 to an E bank account (Account number: G) in the name of the same E branch of the E Bank located in the same Gu, located in the same Gu, at around 13:55 on the same day, a person under whose name it was named was attached to a transparent plastic bag in the non-house mold located in Seocho-gu Seoul, Seocho-gu, Seoul; and (d) then, (c) took five grams with a two-dimensional tape attached to a plastic tape.

Accordingly, the defendant purchased philophones.

2. Medication of phiphones.

A. On the same day as above 1, 21:00, the Defendant 1 administered the fluoral phone H apartment I at the residence of the Defendant, as in the foregoing paragraph 1, in a manner of inserting the fluoralphones purchased into a glass inhaler and inhaleing the smoke generated by heating the bottom of the fluor.

B. On March 2018, the Defendant, at the same place as above 23:00 around the middle 23:00, administered the fluoral volume among the philophones purchased, such as the foregoing 1, in the same manner as the above 2-A.

On May 6, 2018, at the same place as above 22:00 around 22:0, at the same time as above 2-A, the Defendant administered the fluoral volume among the philophones purchased as above 1 in the same manner as above 2-A.

3. On May 9, 2018, the Defendant possessed marijuana, at around 09:26, carried the Defendant’s residence indicated in the above-mentioned No. 2-A, and carried 1.03 grams in vinyl bags and stored it in the said plastic bags. The Defendant was able to smoke by smoking.
