1. The defendant shall pay 34,00,000 won to the plaintiff and 15% per annum from January 8, 2015 to the day of complete payment.
Reasons
1. Facts of recognition;
A. (1) On April 2, 2012, the Plaintiff subscribed to the Defendant’s “non-dividend Social CI Integration Insurance” (hereinafter “instant insurance”) by having B, the spouse of the Plaintiff as the insured.
(2) According to the instant insurance contract, where the insured was diagnosed and confirmed as a "serious disease", the Defendant shall pay 40 million won, which is 80% of the basic insurance amount (50 million won) according to the main contract (the KF Insurance Money) to the Plaintiff, the beneficiary, and where the insured was diagnosed and confirmed as a "satisfying", six million won shall be paid to the Plaintiff according to the special agreement on additional guarantee of CI in accordance with the special agreement on additional guarantee.
B. (1) According to the terms and conditions of the insurance contract of this case, the term “serious disease” includes significant cancer. The term “serious cancer” refers to a malicious species that exists with malicious cells and can be characterized by dive and destroyed proliferation of malicious cells around the insurance contract of this case (Provided, That this does not apply where it falls under genetic cancer, dypine cancer, and dypical dypical dypical dypical dypology).
The term "finite species" means diseases specified in the Korean Standard Disease Classification (Korean Standard Disease Disease Classification) or the U.S. S. S. S. S. S. S. S. S. S. S. S. S.
(2) 그리고 암 또는 경계성 종양의 진단 확정은 해부병리 전문의사 또는 임상병리 전문의사 자격증을 가진 자에 의하여 내려져야 하며, 이 진단은 조직(fixed tissue)검사, 미세침흡인검사(fine needle aspiration biospy) 또는 혈액(hemic system)검사에 대한 현미경 소견을 기초로 하여야 한다.
