A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
The defendant, under the name of "C", was engaged in the activities of "E church" on the fourth floor of the building in Gangseo-gu Seoul Metropolitan Government, and there is no property, and the lease deposit of the above "E church" is also raised by borrowing 200 million won from "F," which is a new letter, and it is urgent to pay not less than 25 million won per month due to the monthly rent of the above church and the interest on the existing loans, and therefore there is no intention or ability to repay even if he borrows money from others.
1. On August 28, 2007, the Defendant made a false statement to the effect that, although he did not have the intent or ability to pay the purchase price of KRW 100 million due to the above financial situation, he would pay KRW 10 million to the victim G after one month, and KRW 20 million after three months, and the balance KRW 70 million will be repaid without the mold until February 28, 2008.
The Defendant received from the victim the 15th class 1,80,000 won (10,000 won) of the 15th class 1, such as the key and height of the 2002 World Cup anniversary of the 2002 World Cup.
2. The criminal defendant against the victim H had no intent or ability to complete payment, even though he/she borrowed money from others due to the above financial situation:
A. From the end of April 2008, false statement to the effect that he/she will use only one month to the victim H who is a believers and complete payment at the above E church, and that he/she shall receive 20 million won from the victim, i.e., the victim's seat, as a loan, from the victim;
B. On December 31, 2008, false statement to the effect that the above E church will use only 2-3 months and complete payment to the above victim, which is five million won from the victim, i.e., the money borrowed from the victim;
C. Around April 10, 2009, a false statement is made to the effect that “If the above victim lends 2 million won as he/she needs to pay the money to him/her, he/she shall be paid the money immediately” to the above victim, and the money is borrowed from the victim.
