1. The Defendant’s KRW 789,390,000 for the Plaintiff and 5% per annum from October 1, 2017 to December 1, 2017.

1. Facts of recognition;

A. On April 27, 2016, the original Defendant entered into a contract with the Defendant for the construction of Jincheon Factory (hereinafter “instant construction”) from the Defendant located in Jincheon-gun, Jincheon-gun, and entered into a construction contract with the Defendant for the construction period from April 28, 2016 to October 30, 2016, with the construction cost of KRW 2,200,000 (including additional tax). On October 30, 2016, the construction period of the instant construction was changed to June 30, 2017.

The Bank of Bankruptcy E and the subcontractor, who is the project owner, shall enter into a contract for construction works as follows:

Article 1(Definitions) This Agreement is a modified contract for "Seoulcheon Factory Construction Co., Ltd. (3 block)" entered into on April 27, 2016.

Article 2 (Amendment of Contracts) Amendment to Original Contracts shall be as follows:

B. On December 2, 2016, the Plaintiff and the Defendant drafted a contract under which the content of the instant construction project is modified as follows (hereinafter “instant modified contract”).

C. The Plaintiff, while proceeding with part of the instant construction, suspended construction around June 2017, and issued a tax invoice in an amount equivalent to KRW 1,570,000,000 in total, until June 7, 2017, regarding the instant construction cost.

On June 30, 2017, the Plaintiff and the Defendant drafted a written agreement to terminate the instant construction contract (hereinafter “instant agreement”) with respect to the instant construction project as follows:

Contract Name: The contract amount of the New Construction Project (3 BD) in Jincheon Co., Ltd.: The contract period of KRW 2,750,00,000: April 28, 2016 to June 30, 2017: the contract period of a long-term (including the agreement as of December 2016) due to the reasons for the failure to pay the contract price and the reasons for termination of the contract: the contract period of a party ordering the contract (including the date after December 2016).

1. A project owner shall not exceed September 30, 2017, 200, 2789,390,000 won for the unpaid construction price.
