Punishment of the crime

1. The Defendant violating the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. is an insurance solicitor (GFC) affiliated with Samsung Bio-branch D.

The Defendant intended to recruit insurance solicitors against job seekers registered in the employment safety information network operated by the Korea Employment Information Service under the Ministry of Employment and Labor, but the Ministry of Employment and Labor denied the job offer advertisement on the ground that they were not workers, and the Ministry of Employment and Labor intended to recruit insurance solicitors by individually viewing personal information, such as the desired type of occupation, contact number, etc. of job seekers.

On December 12, 2013, the Defendant, without any authority, entered the said Worknet (www.work.go.kr) into the said Note’s ID and password, accessed personal information, such as G phone number, registered as a job seeker, and then recruited insurance solicitors by making a phone call from September 25, 2013 to May 22, 2014, and perused approximately 14,000 personal information.

Accordingly, without legitimate access, the defendant invadeds on the employment safety information network operated by the Korea Employment Information Service.

2. Any person who recruits workers in violation of the Employment Security Act shall not make any false job offer advertisement or suggest false job offer conditions;
