A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

1. Any person who gives or receives psychotropic drugs (Article 2 subparagraph 3 (a) shall not give or receive them, and any person other than a person handling narcotics shall not give or receive marijuana;

Nevertheless, on August 2013, the Defendant purchased 40 grams of a total of KRW 11,50,000 from F and E as indicated in attached Table 1, such as purchase of a single spam “Ss” (5F-KB-48, UR-144, etc.; hereinafter “spams”) designated as temporary narcotics equivalent to KRW 2,00,000,000 from F and E, from around the 12th Government Station of the Dongdaemun-si, Seoul, Gaman Park Jong-si, Seoul, and sold to G from the first Government Station of the Republic of Korea on June 2013, the Defendant sold a total of KRW 39,00,000 to G, as indicated in attached Table 2, such as selling a spam of KRW 1,00,000,000 from the purchase price to G, 30,000 won.

3. No person shall use psychotropic drugs (Article 2 subparagraph 3 (a) of the Act);

Nevertheless, the Defendant, on August 2013, posted 0.25g of psychotropic drugs to one cigarette in the park near Dobong-gu Seoul Metropolitan Government, which was located near 1, 2013, and smoked.

In addition, from around that time to around November 2013, the Defendant is in the same way 12 times as indicated in the attached Table 3.
