Reasons
Punishment of the crime
On February 13, 2015, the Defendant was sentenced to imprisonment with prison labor for a violation of the Road Traffic Act (unlicensed Driving) at the Cheongju District Court on August 8, 2015, and the said judgment became final and conclusive on February 24, 2015.
The defendant of "2014 Highest 4428" is an employer who has operated "C" as a service company with 76 full-time workers in Gyeonggi-si B.
In the absence of an agreement between the parties on the extension of the payment date, an employer shall pay wages, compensations, and other money and valuables within 14 days from the date of retirement to February 21, 2014. However, the Defendant did not pay 13 employees, including 7,149,65 won, and 14 days, including 7,149,65 won, within 14 days from the date of the occurrence of the payment cause without any agreement on the extension of the payment date between the parties.
From December 15, 2011 to March 21, 2014, the Defendant retired from the said place of business on April 4, 2014, the Defendant did not pay KRW 7,119,29 within 14 days from the date of retirement, without agreement on the extension of the payment period between the parties to the agreement on KRW 1,637,10, retirement allowances, KRW 5,482,19, total amount of money and valuables, including KRW 1,637,10, and KRW 5,482,19.
The Defendant, from September 4, 2013 to April 24, 2014, paid 1.8 million won of his/her retired worker F who worked in the said workplace and retired from office on April 1, 2014 without an extension agreement between the parties on the payment date, within 14 days from the date on which the cause for the payment occurred.
The Defendant, around May 14, 2014, paid KRW 3,600,000, total of the wages of G, including KRW 1,800,000 on March 17, 2014, and KRW 1,800,00 on April 4, 201, when he/she retired from the said workplace, around May 14, 2014, without agreement between the parties on the extension of the due date for payment between the parties.
