A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

Around April 13, 2017, the Defendant: (a) accessed that the Defendant purchased a phiphone from a phiphone seller of SNS (E:F) using a mobile phone under Article 704 of the “D Building”, the Defendant’s house located in Gangnam-gu Seoul, Seoul, by using a mobile phone around April 13, 2017; (b) made L, who is unaware of the fact, transfer 50,000 won of phiphone to the national bank account (J) in the name of the said seller, designated by the said seller; and (c) made L, who is aware of the fact, transfer 50,000 won of phiphone to the account of the national bank account in the name of the said seller (J) on the same day.
