Reasons
A criminal intent (defendant B) shall not provide personal information to a third party without the consent of the subject of information or a third party, except in cases where there is a special provision in an Act, where it is inevitable for the subject of information or his/her legal representative to comply with the legal obligations, or where it is deemed clearly impossible for the subject of information or his/her legal representative to obtain prior consent due to his/her unknown address, etc., or where it is deemed necessary for the benefit of life, body, or property of the subject of information or the third party, and shall not be provided with personal information from the subject of information with the knowledge of such circumstances.
J is a public official of Grade VII in charge of affairs related to family relations register at the passport of the Seoul L-gu Safety Administration Bureau in Seoul and the family relation registration team in Seoul K from 2008 to 2008, and a personal information manager.
Nevertheless, around November 9, 2011, the J requested the Defendant B to inform the Defendant of personal information, such as the N's address, etc. to recruit the Plaintiff in the instant M-related review case at the Defendant L-gu Seoul Office's passport and family relation registration team office. Around that time, the J connected the resident registration information system with one's ID and password to illegally access the above N's resident registration data, and provided Defendant B with personal information, such as the place of resident registration, which was obtained by illegally accessing the aforementioned N's resident registration data. Defendant B was provided by the J despite being aware of the circumstances.
The J along with this, from November 8, 201 to November 13, 2013, 31 individuals subject to information obtained by accessing the resident registration information system and the family relation registry system at least 54 times, as described in the foregoing method, from around November 8, 2011 to around November 13, 2013.
