Punishment of the crime
A personal information manager shall not provide any personal information to a third party without the consent of the subject of information or a third party, except where otherwise expressly provided for in Acts, where it is inevitable to comply with the legal obligations, or where the subject of information or his/her legal representative is unable to express his/her intent or where it is clearly impossible to obtain prior consent due to his/her unknown address, etc., and where it is deemed necessary for the benefit of an imminent life, body, or property of the subject of information or the third party, and shall not be provided with personal information from the subject of information with
The Defendant is a Grade 7 public official and personal information manager in charge of affairs related to family relations register at the civil petition passport and family relation registration team of Seoul E-Gu office in Seoul, E-gu, Seoul, from around 2008 to the present.
Nevertheless, around November 9, 2011, the Defendant requested the F to inform him of personal information, such as the address of H to recruit the Plaintiff in the instant G-related case at the civil petition passport and family relation registration team office of the Seoul E-gu Seoul E-gu office, and around that time, provided the F with personal information, such as the place of resident registration of the said H, which was obtained by illegally accessing the resident registration data of the said H’s household by accessing the resident registration information system with his ID and password, and the F was provided by the Defendant with the knowledge of the circumstances.
In addition, the Defendant’s consent to 34 personal information acquired by accessing the resident registration electronic information system and the family relation registry system on 57 occasions as described in the aforementioned method between July 22, 2011 and November 13, 2013.
