The defendant's appeal is dismissed.
Reasons
1. The gist of the reasons for appeal was that the Defendant was demanding the victim to answer by pushing ahead of the left hand hand hand hand. At that time, the teacher who operated a course in the classroom as seen above was able to see the Defendant’s body in order to do so, and the Defendant was deprived of his central body, and the Defendant’s left hand hand hand hand hand over in contact the victim’s body, and thus, the Defendant’s hand over intentionally did not injure the victim’s body.
2. The Defendant asserted to the same effect in the lower court, and the lower court rejected the Defendant’s allegation on the grounds of specific reasons.
In addition to the judgment of the court below, the teacher who operated a course at the time of the instant case was present as a witness at the trial of the party, and the witness was present at the trial of the court below and changed to be out of the classroom.
The Defendant did not have any movement at all.
Therefore, the victim who was seated on the front of the classroom (to avoid the defendant) was followed by the victim (to avoid the defendant), and accordingly, the victim tried to follow the classroom, and the defendant divided the victim's shoulder and gets seated again. In light of the gender, physical strength, the location of the defendant and H at the time, etc., H puts the defendant's arms.
Even if the defendant seems to have lost the center, such as H's testimony, and if the defendant had interestd and decomposed to the extent that he would come back with the shoulder of the victim who tried to go back to the classroom according to the direction of the teacher, the defendant appears to have been pushed down with the victim's satisf in the process of demanding the victim to answer in a serious appraisal, so the judgment of the court below that recognized the credibility of the victim's statement is just, and there is no error of mistake of facts as pointed out by the defendant.
3. The Defendant’s appeal is without merit.
