A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On February 20, 2012, around February 20, 2012, the Defendant: (a) at the Cheongju-si University; (b) opened a mobile phone in the name of D; (c) received a written application for subscription to a mobile phone from a case company; (d) from the first floor graduate school of the cultural and social sciences of the C University; (d) entered “D” in the name column of the application for subscription to the mobile phone; (d) in the resident registration number column; (d) entered “E” in the resident registration number column; (e) in the customer address column; and (d) signed in the buyer column with the name of D; and (d) signed in the name of each applicant column of the written consent for the utilization of personal information.

As a result, the Defendant forged the application form for mobile phone subscription in the name of D, which is a private document on rights and duties, and one copy of the written consent for the utilization of personal information, with the intention of uttering. The Defendant sent the forged application form for mobile phone subscription and the written consent for the utilization of personal information in the future of the K Product Co., Ltd., which is aware of the forgery at the same date and at the same place, by mail as if the document was duly formed, and exercises it. On February 21, 2012, the Defendant received the mobile phone application amounting to KRW 932,800 at C University from the victim K Product Co., Ltd. by mail and obtained it by mail.

On February 24, 2012, around February 24, 2012, the Defendant: (a) opened a mobile phone under the name of Da and received a loan; (b) entered “D”, “H”, “E”, “E”, and “D” in the resident registration number column; and (c) signed and sealed “D” in the applicant customer column.

Accordingly, the defendant, for the purpose of uttering, has forged one copy of the new contract to join a mobile phone in the name of D, which is a private document related to rights and obligations, and can know the name of the above G at the same time and at the same place.
