A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. On September 2012, the Defendant opened a fraudulent bank account from C, which is a cash withdrawal book for the Hasing organization, and listens to the statement that C will offer 400,000 won per the face-to face account, and C, who knowingly acquired another’s identification card and decided to open an account by stealing his/her name with the awareness that the account will be used for a crime. The Defendant was willing to acquire another’s identification card and used it by stealing his/her name. The Defendant got D and E’s driver’s license for his/her own car from his/her employee on the PC bank, in which the name at the front city is unknown, and opened a financial account by stealing his/her own name, and opened a financial account by stealing his/her own misappropriation from his/her employee, and by using his/her name “F (Detention on March 21, 2013)” (so-called “D”).
On September 27, 2012, the Defendant forged a private document, the uttering of a private document, or the unlawful uttering of an official document at a post office located in Kuamamamamamamamamamamam-dong, using a verification pen in the form of a written application for opening a financial account, indicating “E” and “H” in the name indication column, “E” and “E” in the address column, and signed at will in front of the name of the establisher.
As above, the Defendant submitted a forged E’s application for opening a financial account under the name of E, as if the application was genuine to a post office employee who was unaware of the circumstances.
The defendant continuously presented to the above I a Class I driver's license for a Class I ordinary motor vehicle for E in the name of the Commissioner of the Korean Police Agency, a public document, as if he had been in possession.
Accordingly, for the purpose of uttering, the Defendant forged a written application for opening a financial account in the name of E, which is a private document on rights and obligations, and exercised it, and illegally uses a driver's license for E, which is an official document.
