1. The part of the judgment of the court of first instance requesting the confirmation of ownership shall be revoked, and the lawsuit shall be dismissed;
2. The plaintiffs.
Reasons
1. The facts falling under any of the following subparagraphs may be found to be in dispute between the parties or together with the overall purport of the pleadings in each entry in Gap evidence Nos. 1, 3, 7, 8, 10, 22, and 25 (including the numbers with which each number is attached; hereinafter the same shall apply):
The land research division for Q of Gyeonggi-gun, which was prepared during the Japanese occupation period, stated that the F, who had resided in the North E of Sung-gun, G, G, and Sung-gun on March 29, 1912 (Name 45) was under the circumstances of the said C, G, 95 (hereinafter “instant land”).
B. In around 1941, the instant land was changed to the RR of Gyeonggi-gun, and the land category was changed from the building site to the road on December 1, 1959, and the area unit was changed from February 10, 1978 to 314 square meters.
C. The defendant (the Ministry of Construction and Transportation: the Ministry of Construction and Transportation) completed the registration of initial ownership on the land in this case by the Suwon District Court No. 6980, Apr. 8, 1996, which received on April 8, 1996.
The instant land was combined with H. H. 175 square meters on January 12, 2005, and was 489 square meters on the Gyeonggi-do R (which became EM thereafter) 101. At present, the instant land is 314 square meters in the ship that connects each point of the attached Table 8, 9, 4, 5, 6, 7, and 8.
E.
