Reasons
Punishment of the crime
On December 12, 2019, the Defendant was sentenced to a suspended sentence of three years in the year and June of imprisonment with labor for a violation of the Road Traffic Act at the Daegu District Court on December 12, 2019, and such sentence became final and conclusive on December 20, 2019.
The defendant is the representative of the event agencyB, who is entrusted by C representative D on April 2019 to operate the "F" in Simsan City E, and has overall control over the planning, event cost raising, and execution of the above event.
In planning the above event, the Defendant received a local subsidy of KRW 66 million from the time of the victim warning by submitting an application and a business plan stating that the expenses to be incurred in the above event are KRW 58,190,000,000 ( KRW 4 million and KRW 66,000,000) even though the expenses to be incurred in the above event are only KRW 58,000,000,000,000,000,000,000,000,000,000,000,000,000).
Accordingly, on May 8, 2019, the Defendant submitted to the public official in charge of subsidies from the Sinsan City to the 159 Sinsan City, a “application for subsidies from the Sinsan City” to apply for subsidies of KRW 66 million necessary to hold the above event. On May 8, 2019, the Defendant received KRW 66 million as local subsidies from the Sinsan City to the Agricultural Cooperative (G) account under the name of the victim Sinsan City, and reported on July 2019 to execute all the project expenses as stated in the above application for subsidies.
However, in fact, the project cost under the above application for the grant of the above local subsidy was unrefiled, and the Defendant divided the amount so unreftened as above by means of public performance business operators, equipment rental business operators, etc., but received a return, and was later used for the purpose necessary for the project of this case, such as a written estimate and contract.
