Punishment of the crime
Defendant
A is a person operating the C Co., Ltd. (hereinafter referred to as the “C”) with the location of the G in Seogpo-si, and Defendant B is a person operating the I Co., Ltd. (hereinafter referred to as the “I”) with the location of the G H.
1. From September 201, Defendant A and the Defendants: (a) around September 201, 201, Defendant B entrusted the Agricultural Product Collection Work necessary for the above project to Defendant B; (b) around KRW 68,300,000 for the Agricultural Product Collection Project implemented by the C in Seopopo City selected as a subsidized project operator (total project cost of KRW 500,000,000, national subsidy of KRW 250,000, local subsidy of KRW 100,000, local subsidy of KRW 150,000,000 for the Agricultural Product Collection Project; and (c) Defendant B conspired Defendant B to refund the difference between the actual project cost and the actual project cost after receiving the full payment of the relevant construction contract amount of KRW 68,30,00,00 for the Agricultural Product Collection Project.
Accordingly, around September 8, 201, Defendant A deposited KRW 150,000 in the Agricultural Cooperative (K) account in the name of the Agricultural Cooperative (hereinafter “C subsidy account”) (hereinafter “C subsidy account”), which is an exclusive subsidy account, and on the same day, submitted a copy of the above account book to the public official in charge of Seocho-si and submitted the copy of the above account book to the public official in charge of Seopo-si and deemed that Defendant A had the intent or ability to pay the total amount of self-paid charges of KRW 150,00,00
On the other hand, Defendant A awarded a contract for the extension work of the agricultural products collection center to Defendant B to Defendant B’s operation, and Defendant B submitted a contract for the construction work to set the new construction cost of the agricultural products collection center at KRW 501,200,000 to Defendant A on September 25, 201.
However, the above construction cost of KRW 501,200,000 was less than the actual construction cost of KRW 68,300,000.
