Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, as the victim C (the 7 years of age at the time of committing each of the crimes in this case), was aware of the fact that the victim was unable to make an objection against the Defendant by force without any proper concept of sexual intercourse, and was willing to commit an indecent act by using it.

2. At around 19:00 as of December 2, 2003, the Defendant: (a) 19:00, at the above residential toilet, she saw the victim to take a bath; (b) laid the victim on the toilet floor; and (c) laid the victim into the toilet floor; and (d) laid the victim’s chest and the father, she forced the victim under 13 years of age to commit an indecent act.

3. At around 19:00 as of February 2, 2004, the Defendant: (a) 19:00, at the above residence toilets, she saw the victim to take a bath; (b) laid the victim on the toilet floor; and (c) laid the victim into the toilet floor; and (d) laid the victim’s chest and the father, she forced the victim under 13 years of age to commit an indecent act.
