피고인은 2018. 10. 27. 19:40경 군산시 B에 있는 C 앞길에서 전처인 D과 다투게 되어 차에 타고 있던 D을 향하여 열린 차 창문 틈 사이로 침을 뱉고 보닛 위로 올라가 앞 유리를 발로 차는 등 난동을 부려, 이에 ‘전 남편이 와서 욕을 하고 행패를 부린다, 차 위에 올라와서 유리창 깨려고 난리를 피운다’는 취지의 위 D의 112 신고를 받고 즉시 출동한 군산경찰서 E파출소 근무 경찰관 경사 F로부터 신분증 제시를 요구받자, “내가 뭘 잘못했다고 체포하냐, 할 테면 해 봐라”고 하면서 끝까지 인적사항을 밝히지 않아 폭행죄 등의 현행범으로 체포되어 순찰차로 이동하는 과정에서, “씨발, 안 놔 ”라고 욕설을 하며 오른발로 위 경찰관의 왼쪽 정강이를 1회 걷어찼다.
