Defendant
A and Defendant B shall be sentenced to 8 months of imprisonment, 4 months of imprisonment for Defendant C, and 1,00,000 won of fine for Defendant D.
Reasons
Punishment of the crime
1. From December 2015, Defendant A and Defendant B had been living in the workplace of Defendant B, Seo-gu H 303, Daegu-gu, and had a cash of KRW 15 million owned by Defendant B as Defendant A’s proposal, and Defendant A purchased smartphone at a low price in Seoul, Gyeonggi-gu, and Defendant B shared profits by selling smartphone at a large quantity at a low price and selling it again at a low price.
The Defendants conspired with Defendant B to stand for the purchase of smartphones, and Defendant A purchased and acquired 28 cell phoness, a total of 20 times from around February 19, 2016 to March 12, 2016, by purchasing and purchasing 3.50 million won in cash, even though he/she was aware of the fact that he/she acquired in the public toilets of the Seoul subway Station, from Defendant B’s non-personal phone 20 times in total, as shown in the list of crimes, from around February 19, 2016 to around March 12, 2016.
2. Defendant C
A. On February 17, 2016, the Defendant acquired stolen goods by giving approximately KRW 400,000 and purchasing approximately KRW 400,00 of smartphones ( Samsung Gallon 4, etc.) that he/she acquired from his/her non-nameless taxi drivers in front of the Dong-gu Daegu Station located in Daegu-gu, Daegu-gu, 550 (Seoul-dong).
B. On February 20, 2016, at around 15:30, the Defendant purchased only KRW 1,00,000 and acquired stolen goods with the knowledge of the fact that the victim J was placed in the taxi (gallon No. 1) and the victim K, which the Defendant purchased from the taxi platform in the same Daegu Daegu-gu, by purchasing only KRW 1,00 with the knowledge of the fact that it is a stolen goods.
3. The Defendant D, around 13:00 on December 11, 2015, 201, 200: (a) the market price between the persons who suffered damage to their names and incompacts among the persons with disabilities in the subway stations located in Seocho-gu Seoul, Seocho-gu, Seoul.
