나. 피고인은 2013. 10. 17. 08:27경 창원시 마산합포구 산호동 소재 신세계백화점 마산점 앞에 정차된 D 시내버스 내에서 전항과 같이 피해자 C에게 보복을 할 목적으로, 피해자에게 벌금을 대신 내 줄 것인지를 물어본 후 피해자가 그렇게 할 수 없다고 말을 하자 "야이 씨발놈아, 내가 이렇게 사니까 아무것도 아닌 것처럼 보이나 내가 이래봬도 사람을 2명이나 죽였다. 한명은 몽둥이로 때려 죽였고, 한명은 칼로 찔러 죽였다. 시내에 내 똘마이가 10명이 넘는다. 그 10명 풀면 니 죽는다. 너희 집 알아 났다. 너희 식구들 가만히 안 둔다“라고 말하였다.
