A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 22:45 on May 29, 2015, the Defendant: (a) driven a eFsty or other car while under the influence of alcohol at approximately 0.148% in the section of 3.8km from the Saemaeul restaurant located in the original city level to the 103-dong parking lot of the same city apartment.
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (U.S.) and the Road Traffic Act (U.S.) are those who are engaged in driving a DF rocketing car.
On May 29, 2015, at around 22:45, the Defendant driven the above vehicle while under the influence of alcohol of 0.148%, and driven the front distance of the F in E at the prime city, from the prime medical center to the south side market.
Since the place is a private road crossing, a driver of a motor vehicle has a duty of care to operate the motor vehicle safely by properly operating the steering and brake system along his/her own car line.
Nevertheless, the Defendant neglected this and went along the breath of the vehicle in front of the left-hand part of the H Hast Engine that was driven by the victim G(the age of 22) who was parked in the signal atmosphere due to the negligence of driving the vehicle under the influence of alcohol as above.
Ultimately, the Defendant, by the above occupational negligence, suffered from the victim I (the age of 23) aboard the above G and the victim I (the age of 23) with respect to the necks and tensions of the bones in need of approximately two weeks of medical treatment, and at the same time, destroyed the above rocketing vehicles owned by the victim J to cause danger on the road by damaging the strawer, etc. of the repair cost of KRW 543,156 of the repair cost, but escaped without taking measures to rescue victims, prevent danger on the road, and ensure smooth traffic flow.
