A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 14:40 on November 7, 2015, the Defendant driven a dart XG car in the state of alcohol alcohol concentration of about 8km from the original fright village located in the driving dong at the original city to the residential area located in the same city C.
2. The Defendant is a person who is engaged in driving of a vehicle XG in Category D Art 10, in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., an escape vehicle) and the Road Traffic Act (ii).
On November 14:40, 2015, the Defendant driven the above-mentioned vehicle and driven the 291 academic wing-ro 1,000 from the direction of the original police station to the Thai-ro.
Since the place is a three-distance intersection with signal apparatus, the driver of the motor vehicle has a duty of care to safely operate the steering direction and brake system by observing the signal.
Nevertheless, the Defendant neglected this and caused the Defendant to have the front part of the Defendant’s vehicle driving ahead of the FTco car driven by the Victim E (56) driving from the direction of the original police station to the normal driving by negligence in contravention of the red signal.
Ultimately, the Defendant suffered from the victim G (54) on board the above E and the above E-Co vehicles by occupational negligence for about three weeks, and at the same time, destroyed the above TCo vehicles owned by the victim E to repair the 2,881,371 won, thereby causing any danger on the road, but escaped without taking any measures such as rescue for the victims.
