1. The Defendant (Counterclaim Plaintiff) is jointly and severally liable to the Plaintiff (Counterclaim Defendant) for KRW 20,570,000 and its amount from September 13, 2016.
Reasons
1. The principal lawsuit and counterclaim shall be deemed to be filed together with the facts of recognition;
A. The Plaintiff is a corporation with the purpose of a real estate management agency business, such as the lease management of commercial buildings and housing, and was entrusted by the Defendants with the lease brokerage of three-story buildings owned by the Defendants, Yongsan-gu Seoul Metropolitan Government (hereinafter “instant building”).
B. On August 26, 2015, the Defendants concluded a lease agreement on the instant building (hereinafter “instant lease agreement”) with the wheel Korea Co., Ltd. (hereinafter “Wheel Korea”) on the following terms as the Plaintiff’s brokerage:
Article 1 (Period of Lease) (1) The term of the lease contract shall be from January 1, 2016 to December 31, 2020 (five years). 2) When a request for renewal of the contract is made, such as adjustment of the lease rent, the intention shall be notified in writing to the other party three months prior to the expiration of the contract.
Article 2 (Lease Deposit) (1) The deposit shall be KRW 1,00,000,000 per day (1,000,000). The monthly rent under Article 3 (1) shall be KRW 35,000,000 in daily rent (35,00,000).
(A) The monthly rent shall be determined by mutual consultation within five per two years after the lapse of two years from the date of commencement of the contract. Article 4 (Method of Payment of Security Deposit) 1) The method of payment of security deposit shall be as follows:
Down Payment:0 billion won (200,000,000 won) - Payment at the time of a contract
B. The remainder: daily gold worth (80,000,000) - The current lessee may order the object and sell to a third party the right to preferential purchase during the lease duration under Article 18 (Special Agreement) 2 on the date on which the lessee commences possession or the date on which the lessee starts construction. 3) When the Defendants intend to sell or sell the instant building, they may give the wheel Korea priority to purchase the instant building, check the wheel Korea’s intent to purchase and sell the instant building, and then sell it to the third party if the wheel Korea waives the right to purchase the instant building.
