A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 성폭력범죄의처벌등에관한특례법위반(공중밀집장소에서의추행) 피고인은 2019. 10. 25. 18:10경 서울 서초구 B에 있는 지하철 9호선 C역 승강장에서, D역 방향으로 가는 급행 전동차를 기다리면서 성명불상의 여성 피해자의 뒤에 줄을 서 있다가 전동차가 도착하자 전동차에 탑승하면서 피해자의 엉덩이에 피고인의 성기를 비볐다.

피고인은 계속하여 같은 날 18:16경 위 전동차에 탑승하여 D역까지 간 후, D역에서 탑승한 성명불상의 여성 피해자의 뒤로 다가가 피해자의 엉덩이에 피고인의 성기를 비볐다.

Accordingly, the defendant committed an indecent act against the victims in the former vehicle which is a means of public transportation.

2. On October 24, 2019, the Defendant: (a) around 19:00 on October 24, 2019, acquired a copy of the credit card (credit card number : F) owned by the victim E, on the crosswalk, which is located underground in the 102 studio of the Gangnam-gu, Gangnam-gu, Seoul, for a new logic that is located underground in the 102-distance st

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

3. On October 24, 2019, the Defendant violated the Specialized Credit Financial Business Act: (a) around 22:00, on board a bus at a bus stop in Gwanak-gu, Seoul Special Metropolitan City; (b) paid a fee by linking the credit card acquired with the card terminal installed on a bus; and (c) from that time until October 26, 2019, the Defendant paid a total of 12,100 won of buses or subway fares in Seoul, light, bus stops or subway stations in the same way as indicated in the separate crime list in the Seoul, light, and sublets.

As a result, the defendant entered information into a computer and other information processing device without authority, thereby making the above bus and subway.
