1. 피고인은 2019. 7. 23. 08:40경 서울 영등포구 B에 있는 지하철 9호선 C역의 D 방면 승강장에서 검정색 청바지와 하얀색 반팔티셔츠를 입은 성명을 알 수 없는 피해자(여, 연령미상)가 전동차에 승차하는 것을 보고 위 피해자의 뒤에 바짝 붙어 가면서 피해자의 엉덩이에 왼쪽 손등을 갖다 대고, 위 전동차에 승차하고 나서 피해자의 뒤에 바짝 붙어 서서 피해자의 엉덩이에 왼쪽 손등을 갖다 댔다 뗐다를 반복하였다.

2. 피고인은 2019. 7. 23. 08:55경 서울 동작구 E에 있는 지하철 9호선 F역의 D 방면 승강장에서 진녹색 니트를 입은 성명을 알 수 없는 피해자(여, 연령미상)가 전동차에 승차하는 것을 보고 위 피해자의 뒤에 바짝 붙어 가면서 피해자에게 몸을 밀착하면서 피고인의 성기를 피해자의 엉덩이 부위에 갖다 댔다.
