A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Nevertheless, the defendant had already received an export declaration while operating the LAD and E, and had the intention to sell cars which are foreign goods in Korea without withdrawal of export declaration or import declaration.

1. Around November 4, 2009, the Defendant altered official document: (a) at the office of the Dispute Resolution Co., Ltd., which had been operated by the Defendant, the second floor A-18 of the F Building in Kimpo-si, Kimpo-si without authority; (b) without authority, printed out the annual formula and the chassis number of the “2001 H” in the name of the head of the Incheon Headquarters in a computer with the size the same as that of the original export declaration certificate, which is in the name of the head of the Incheon Headquarters; and (c) attached the export declaration number in the name of the head of the Incheon Headquarters, which is an official document, in a re-printed manner, in the name of the head of the Incheon Customs Office, one copy of the export declaration number under the name of the head of the Incheon Headquarters, and changed the number of the public document and the number of the 58-year government document, which is an official document to cancel the registration number and the number of the 10-year government certificate in the name of the head of the Incheon Headquarters.

2. The Defendant violated the Customs Act (hereinafter referred to as the "Smuggling") shall have the export declaration number J on November 5, 2009 to the head of the Incheon Headquarters customs office.
