Punishment of the crime

On July 23, 2014, the Defendant was sentenced to a suspended sentence of imprisonment with prison labor for four months at the Incheon District Court for fraud, and the said judgment became final and conclusive on July 31, 2014.

Around June 13, 2014, the Defendant posted a false statement to the effect that he/she sells excreta bags to Neinna, an Internet site, at the Defendant’s house located in Gyeyang-gu Incheon, Gyeyang-gu, 103 606 Dong, and that he/she would send the instant bank to the victim D who reported and contacted the sales.

However, the defendant had no intention or ability to send bags even if he receives the price of the goods because he did not have the excreta bags at the time.

As above, the Defendant, by deceiving the victim as above, received 380,000 won from the Nonghyup Bank (E) in the name of the Defendant for the same day from the victim as the price for goods on the same day, and received a total of 6,597,000 won from July 25, 2014 in the same way from that time until July 25, 2014.

On August 3, 2014, the Defendant posted a false statement to the effect that, at a place where the address of Gyeyang-gu Incheon Metropolitan City is unknown, the Defendant would sell the excreta bags to the Internet NAVF car page using his/her smartphones, and that, at a place where the address of Gyeyang-gu Incheon Metropolitan City is unknown, the Defendant sent a false statement to the victim G who reported and contacted with him/her to the effect that “I would send a bank to the face of remittance of money.”

However, the defendant had no intention or ability to send bags even if he receives the price of the goods because he did not have the excreta bags at the time.

As above, the Defendant, by deceiving the victim as above, acquired 510,000 won from the victim to the account of community credit cooperatives (I) in H under the name of the same day as the price for the goods.
