A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

[criminal power] The defendant was sentenced to 10 months of imprisonment with prison labor on June 3, 2020 by Busan District Court for embezzlement of stolen objects, etc., and the judgment on August 28, 2020 becomes final and conclusive.

【Criminal Facts】

1. On December 20, 2019, the Defendant: (a) around 11:40 on December 20, 2019, the Defendant: (b) on the part of the Busan East-gu Busan-gu, but did not take necessary procedures, such as acquiring a man’s envelope equivalent to the market price of KRW 80,000 on which the victim B lost, BC (Welfare Card of the Korea Customs Service) and B/C card; and (c) returning it to the victim.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. On December 20, 2019, the Defendant entered the information on the purchase of beverages equivalent to KRW 1,800 in the market price, into the card input, which was installed in Busan Station located in 206 as the center of Busan Dong-gu, Busan, and then paid KRW 1,800,00.

Accordingly, the defendant used lost credit cards and obtained financial benefits by inputting information without authority to the information processing device such as computers.

3. An occupation of using a new check;

A. On December 22, 2019, the Defendant, around 14:22, 2019, purchased goods equivalent to KRW 4,800 of the market price in Busan, on December 22, 2019, and subsequently completed the purchase as if he/she was the legitimate licensee of the new physical card in the above B’s name, which he/she acquired as in paragraph (1). The Defendant tried to present the said new physical card to his/her employees on the part of the victim’s name and to receive the goods after settling the price, but the settlement approval was refused due to the said report on the loss of the said B and attempted to receive the goods.
