A defendant shall be punished by imprisonment for not less than two years and six months.

Seized evidence of heading 2, 5, 9 through 14 shall be confiscated.

Punishment of the crime

[Criminal history] On December 15, 2016, the Defendant was sentenced to six months of imprisonment with labor for a violation of the Narcotics Control Act at the Seoul Central District Court on December 15, 2016 and completed the execution of the sentence on May 11, 2017.

[2] Notwithstanding the fact-finding that the Defendant is not a handler of narcotics, the Defendant treated the Metecule (one philopon; hereinafter “Wlopon”), which is a local mental medicine, as follows.

1. The Defendant, such as the sale of phiphonephones, along with B, advertised the sale of phiphones with the Internet and SNS attachment C (Chyd'D', "E"), received money from those who want to purchase phiphones and received money from those who want to purchase phiphones, and offered a bid for the sale of phiphones by way of informing in advance to the purchasers of the place where phiphones are hidden (the "sale method of phiphones").

A. On July 10, 2017, at around 14:31, 2017, concealing 0.13g of philopon on the gambling house located adjacent to F adjacent to the Suwon-gu, Suwon-si, attach a photograph of the place, and then transmitting the photo to the prosecutorial investigator who tried to run philopon transactions with the Internet advertising report, and send the photo to the prosecutorial investigator who tried to run philopon transactions with C, and then receive philopon by allowing the investigator to find the philopon concealed by the prosecutorial investigator at around 16:32 of the same day;

B. On July 11, 2017, around 18:57, a prosecutorial investigator who reported Internet advertisements and attempted to trade phiphonephones in C, transferred KRW 3.57,00 to a corporate bank account (G) as the price for phiphones. B, around 20:37 the same day, intended B to conceal approximately 0.57 g of phiphones in the pipe behind the building located in the Suwon-gu, Suwon-si, Suwon-si, and then sold phiphones by means of having the prosecution investigator find the phiphones concealed in 20:50 on the same day.

2. The Defendant, together with B, administering philophones.

A. On July 12, 2017, An officetel J around the new wall: (a) inserting approximately 0.05g philopon in a single-use type of an officetel in Ansan-si, An Officetel J around the new wall; and (b) making it a water.
